The National Anti-Corruption Commission (NACC) may deal with reports and referrals in a number of ways. This includes deciding to take no action. 

If you are dissatisfied with the way the NACC decides to deal with your referral, you can apply for a review of the decision. 

Applying for a review

To apply for a review, you can: 

  • complete the Request for Review form online 
  • call us on 1300 489 844 (or through the Translating and Interpreting Service on 131 450). 

You must apply for a review within 3 months of the original decision. An application made more than 3 months after the original decision must demonstrate why it should be permitted, including an explanation for the delay. 

An application for a review must explain why you are dissatisfied with the decision that was made or the actions taken in relation to your matter and identify what you say are the errors in the decision. 

It is important you are familiar with the jurisdiction of the NACC and the elements of corrupt conduct in making a request for review. 

Request for Review form

The Request for Review form asks you to state: 

  1. our reference number – so that we can easily and accurately identify your original report
  2. the date on the correspondence notifying you of the decision 
  3. why you are applying for a review (free text field).

Noting that a review will only proceed if there is a valid reason, you may wish to include answers to the following questions:

  • Do you disagree with all of the decision or a part of the decision? If a part, which part? 
  • Do you think there is a material error of fact or law in the original decision? If so, specify each error and why it is wrong.
  • Do you think the decision failed to have regard to relevant considerations or evidence? If so, please specify what was not taken into account.
  • Do you think there was an incorrect process in making the decision? If so, explain what was wrongly done or omitted.
  • Do you have fresh evidence not available at the time of the original submission or decision? If so, summarise that evidence and attach it (the form allows for up to 2 attachments of up to 5MB each). 

How is my request for a review assessed? 

All review applications are carefully assessed by a staff member who has not previously been involved in a decision on the matter. They will decide if there is a valid reason for a review. 

Valid reasons for a review can include a material error of fact or law in the original decision, failure by the decision-maker to regard relevant considerations or evidence, incorrect process in making the decision, and fresh evidence not available at the time of the original submission or decision.
